Terms of service
These Terms of Service (hereinafter referred to as the "Terms") stipulate the conditions of use for the online shop (hereinafter referred to as the "Service") provided by LoNLy (hereinafter referred to as the "Shop") on this website. Registered users (hereinafter referred to as "Users") are required to use the Service in accordance with these Terms.
Article 1 (Application)
These Terms shall apply to all relationships between the User and the Shop regarding the use of the Service.
The Shop may establish various rules and regulations (hereinafter referred to as "Individual Regulations") regarding the use of the Service, in addition to these Terms. These Individual Regulations, regardless of their name, shall constitute a part of these Terms.
In the event of any conflict between the provisions of these Terms and the provisions of the Individual Regulations set forth in the preceding paragraph, the provisions of the Individual Regulations shall prevail unless otherwise expressly provided in the Individual Regulations.
Article 2 (Registration)
In the Service, an applicant for registration shall apply for registration in the manner prescribed by the Shop after agreeing to these Terms, and the registration shall be completed when the Shop notifies the applicant of its approval.
The Shop may not approve an application for registration if it determines that the applicant for registration falls under any of the following circumstances, and shall not be obligated to disclose the reasons for such determination:
- In the event that the applicant provides false information when applying for registration
- In the event that the application is made by a person who has previously violated these Terms
- In any other case where the Shop deems the registration to be inappropriate
Article 3 (Management of User ID and Password)
The User shall manage the User ID and password for the Service at their own responsibility.
The User shall not transfer or lend the User ID and password to a third party, or share them with a third party, under any circumstances. The Shop shall deem any use of the Service with a combination of a User ID and password that matches the registered information to be use by the User who registered that User ID.
The Shop shall not be liable for any damages caused by the use of a User ID and password by a third party, except in cases where the Shop is intentionally or grossly negligent.
Article 4 (Sales Contract)
In the Service, a sales contract shall be formed when the User makes a purchase application to the Shop and the Shop notifies the User of its acceptance of such application. The ownership of the product shall be transferred to the User when the Shop delivers the product to the shipping company.
The Shop may terminate the aforementioned sales contract without prior notice to the User if the User falls under any of the following circumstances:
- In the event that the User violates these Terms
- In the event that the delivery of the product is not completed due to an unknown address or a long absence
- In any other case where the Shop deems that the relationship of trust between the Shop and the User has been damaged
The payment method, shipping method, method of canceling a purchase application, and method of returning a product for the Service shall be in accordance with the methods separately prescribed by the Shop.
Article 5 (Intellectual Property Rights)
The copyrights or other intellectual property rights to the product photos and other content provided through the Service (hereinafter referred to as "Content") belong to the Shop and the legitimate rights holders such as the Content providers, and the User may not reproduce, reprint, modify, or otherwise make secondary use of them without permission.
Article 6 (Prohibited Acts)
The User shall not engage in any of the following acts when using the Service:
- Acts that violate laws and regulations or public order and morals
- Acts related to criminal activities
- Acts that infringe on copyrights, trademark rights, or other intellectual property rights included in the Service
- Acts that destroy or interfere with the functions of the Shop's servers or networks
- Acts of using the information obtained through the Service for commercial purposes
- Acts that may interfere with the operation of the Shop's services
- Acts of unauthorized access or attempted unauthorized access
- Acts of collecting or accumulating personal information or other information about other Users
- Acts of impersonating other Users
- Acts of directly or indirectly providing benefits to antisocial forces in connection with the Shop's services
- Any other acts that the Shop deems inappropriate
Article 7 (Suspension of Service Provision)
The Shop may suspend or interrupt all or part of the Service without prior notice to the User if it determines that any of the following circumstances exist:
- When performing maintenance, inspection, or updates of the computer system related to the Service
- When it becomes difficult to provide the Service due to force majeure such as earthquakes, lightning strikes, fires, power outages, or natural disasters
- When the computer or communication lines are stopped due to an accident
- In any other case where the Shop determines that it is difficult to provide the Service
The Shop shall not be liable for any disadvantages or damages suffered by the User or a third party due to the suspension or interruption of the provision of the Service, regardless of the reason.
Article 8 (Restrictions on Use and Deletion of Registration)
The Shop may restrict the User's use of all or part of the Service or delete the User's registration without prior notice if any of the following circumstances apply:
- In the event of a violation of any of the provisions of these Terms
- In the event that it is discovered that there are false facts in the registered information
- In the event that the credit card registered by the User as a means of payment is suspended
- In the event of non-fulfillment of payment obligations such as fees
- In the event that there is no response from the User to the Shop's contact for a certain period of time
- In the event that the Service has not been used for a certain period of time since the last use
- In any other case where the Shop determines that the use of the Service is inappropriate
The Shop shall not be liable for any damages incurred by the User as a result of actions taken by the Shop based on this article.
Article 9 (Withdrawal)
The User may withdraw from the Service by following the prescribed withdrawal procedures.
Article 10 (Disclaimer and Exemption from Liability)
The Shop does not guarantee that the Service is free from any defects, whether factual or legal (including defects related to safety, reliability, accuracy, completeness, effectiveness, fitness for a particular purpose, security, etc., as well as errors, bugs, infringement of rights, etc.).
The Shop shall not be liable for any damages incurred by the User through the use of the Service. However, if the contract between the Shop and the User regarding the Service (including these Terms) constitutes a consumer contract as defined in the Consumer Contract Act, this exemption provision shall not apply. Even in this case, the Shop shall not be liable for any damages incurred by the User due to special circumstances (including cases where the Shop or the User could foresee or could have foreseen the occurrence of damages) arising from the Shop's negligence (excluding gross negligence) resulting in a breach of contract or tort.
The Shop shall not be liable for any transactions, communications, or disputes that may arise between the User and other Users or third parties in relation to the Service.
Article 11 (Changes to Service Content)
The Shop may change the content of the Service or discontinue the provision of the Service without notifying the User, and shall not be liable for any damages incurred by the User as a result.
Article 12 (Changes to Terms of Service)
The Shop may change these Terms at any time without notifying the User when deemed necessary. If the User uses the Service after the change of these Terms, the User shall be deemed to have agreed to the changed Terms.
Article 13 (Handling of Personal Information)
The Shop shall handle the personal information obtained through the use of the Service appropriately in accordance with the Shop's "Privacy Policy."
Article 14 (Notices or Communications)
Notices or communications between the User and the Shop shall be made in the manner prescribed by the Shop. The Shop shall deem the contact information currently registered as valid and send notices or communications to that contact information unless the User submits a change notification in the format separately prescribed by the Shop, and these notices or communications shall be deemed to have reached the User at the time of transmission.
Article 15 (Prohibition of Transfer of Rights and Obligations)
The User may not transfer or provide as collateral the status under the terms of use or the rights or obligations based on these Terms to a third party without the prior written consent of the Shop.
Article 16 (Governing Law and Jurisdiction)
The interpretation of these Terms shall be governed by the laws of Japan. The United Nations Convention on Contracts for the International Sale of Goods shall not apply to the Service.
In the event of a dispute regarding the Service, the exclusive agreed jurisdictional court shall be the court having jurisdiction over the location of the Shop's head office.

Article 2 (Registration)

The User shall manage the User ID and password for the Service at their own responsibility.
The User shall not transfer or lend the User ID and password to a third party, or share them with a third party, under any circumstances. The Shop shall deem any use of the Service with a combination of a User ID and password that matches the registered information to be use by the User who registered that User ID.
The Shop shall not be liable for any damages caused by the use of a User ID and password by a third party, except in cases where the Shop is intentionally or grossly negligent.
Article 4 (Sales Contract)
In the Service, a sales contract shall be formed when the User makes a purchase application to the Shop and the Shop notifies the User of its acceptance of such application. The ownership of the product shall be transferred to the User when the Shop delivers the product to the shipping company.
The Shop may terminate the aforementioned sales contract without prior notice to the User if the User falls under any of the following circumstances:
- In the event that the User violates these Terms
- In the event that the delivery of the product is not completed due to an unknown address or a long absence
- In any other case where the Shop deems that the relationship of trust between the Shop and the User has been damaged
The payment method, shipping method, method of canceling a purchase application, and method of returning a product for the Service shall be in accordance with the methods separately prescribed by the Shop.

Article 13 (Handling of Personal Information)

Article 14 (Notices or Communications)
Notices or communications between the User and the Shop shall be made in the manner prescribed by the Shop.
